What a Madison Product Liability Lawyer Does After a Dangerous Product Injures You
A product that malfunctions or turns out to be dangerous can leave you hurt, out of work, and facing medical bills you never expected. You need to know who made it, who sold it, and who may be responsible for what happened to you.
Attorney Alphonse J. Balzano Jr, a Madison personal injury lawyer who has practiced Connecticut injury law since 1992 and has earned a Super Lawyers selection every year since 2021, founded Balzano & Tropiano to represent people harmed by dangerous and defective products, not the companies that make or sell them.
From our office in Madison, we can look at what happened, identify who may be accountable, and explain what your claim could be worth. Reach out today to talk through what you’re facing and what comes next.
Connecticut law allows a product liability claim against anyone in the chain of sale, including the manufacturer, the distributor, or the retailer, when a product injures someone through how it was made, how it was designed, or the warnings that came with it. Our Madison product liability lawyers evaluate claims involving:
Whatever the product, the same two legal questions apply in every case: was it defective, and did that defect cause your injury.
Product defects usually fall into three groups. A manufacturing defect happens when a product comes out different from its intended design. A design defect means the design itself makes the product unsafe. A warning defect means the product did not come with adequate instructions or warnings about a danger. If a defective product hurt you, you may be able to seek payment for medical bills, lost income, and pain and suffering. In some cases, Connecticut law also allows punitive damages when a seller showed reckless disregard for the safety of product users. Those damages cannot be more than twice the damages awarded to the injured person. Every case is different, and we can explain what applies to yours.
Connecticut gives you three years from the date you were first hurt or discovered, or reasonably should have discovered, your injury to file a product liability claim, and generally no more than ten years from the date the seller last had control of the product, under Conn. Gen. Stat. § 52-577a. Miss that window and the right to recover can disappear, no matter how strong the case might otherwise have been.
Why does the deadline matter so much? Evidence disappears. Products get thrown away, repaired, or recalled.
Witnesses forget details, and a company may stop keeping records on an older product altogether. Waiting to act can mean losing proof you will never get back, on top of the medical bills, lost wages, and pain that come with a serious injury.
This information reflects Connecticut law as of October 2026.

Under the Connecticut Product Liability Act (Conn. Gen. Stat. § 52-572m et seq.), you need to show the product was defective and unreasonably dangerous when it left the seller’s control, and that the defect caused your injury. The defect can come from how the product was made, how it was designed, or a failure to warn you about a known danger.
Madison falls within the New Haven Judicial District, along with Guilford, Branford, and the city of New Haven. Civil claims from Madison are generally filed at the Superior Court on Church Street in New Haven.
A recall does not automatically win your case, but it can be strong evidence the manufacturer knew about the danger beforehand. Recall notices, safety bulletins, and prior complaints about the same product often become key evidence in these claims.
Not having the product can make a claim harder, but it does not end it. Photos, medical records, purchase receipts, packaging, and witness accounts can all help establish what happened and what was defective.
Connecticut follows a comparative responsibility rule, so you may still recover damages even if you share some fault, though your recovery can be reduced based on your percentage of responsibility. An honest look at the facts early on helps set realistic expectations for your claim.
A defective product injury does not have to be something you sort out alone, and preserving evidence early can help. Balzano & Tropiano offers free consultations for Madison product liability claims, and we do not charge an attorney’s fee unless we recover money for you.
